General Questions

Where do I get a business license?

At this point, the Town of Moraga does not have business licenses.  Business licenses are a way for a city or town to obtain revenue.  Currently, the Town does not require or issue them.  You are permitted to operate a business from your home.  However, you should not be able to tell there is a business being operated from the residence.  You cannot have clients come to your home or display a sign advertising the business.  Please note: the issue of business licenses is being studied and may change in the future.

Who should I call when I see a dead deer or other dead animal?

Living in a semi-rural area, there are frequent occasions when you see a dead animal along the road or even in your yard. The County has a truck they can dispatch to the scene. You will need to give them a location and answer a few brief questions about the incident. Call Contra Costa County Animal Control Services at (925) 335-8300.

I found a dead bird in my yard, who should I notify?

Due to the possibility of the West Nile Virus, the California Department of Health Services requests that you call 1-877-WNV-BIRD to report it. If the bird is a candidate for testing, they will arrange for a district technician to pick it up. You can also go to the West Nile Virus website for more information.

Which department do I contact regarding mosquitoes, yellow jackets, skunks, and information on the West Nile Virus, etc?

How do I report a problem with street cleaning, clogged culverts, a fallen sign, branches that need trimming, graffiti, and other maintenance problems?

Call the Public Works Department at (925) 888-7026 and be prepared to leave a detailed message and contact information.

I live on a private road in Moraga. Will the Town repair the street?

No, private streets are maintained by the property owners on that street.

What can I do about problems with my neighbors?

Most problems with neighbors are over trees or joint fences, etc. The Town government cannot get involved in private disputes, but there is a free agency called Conflict Resolution which is effective in helping people resolve problems. Their number is (925) 687-8844 X301.

What do I do if there is an unnecessary, excessive, or annoying noise in my neighborhood?

At certain levels noises are detrimental to the health and welfare of the citizenry. The Moraga Municipal Code (§ 7.12) restricts noise levels in residential areas.  If you are disturbed by a loud noise in your neighborhood, please call the Moraga Planning Department at (925) 888-7040 (8 am - 5 pm weekdays) or the Moraga Police Department at (925) 284-5010 (weekends, holidays, and 5 pm - 8 am weekdays).

When can carpenters and workers in Town begin construction?

Construction -- and its associated noises -- may take place in Moraga from 8:00 a.m. until 5:00 p.m.  If someone doing construction disturbs your sleep at 6:00 a.m., call the Police Department and report the incident to them. They can be reached through dispatch at 284-5010.

How can I get an inspector for my newly installed water heater?

Installing a water heater requires a permit from Contra Costa Building Department. Their phone number is 646-2300. Make sure you contact them when replacing or installing a water heater.

Do I need a permit for a yard or garage sale?

No, the Town does not require a permit for yard or garage sales. However, signs advertising for these types of sales must be taken down immediately after the sale is over.

Why don't police give tickets to cars in red zones at shopping centers?

Shopping Centers are private property and are out of the jurisdiction of local police for parking enforcement.  The exception to this is handicapped parking, which local police have the authority to ticket, since it is State mandated. A fine for parking in or obstructing handicapped parking -- even for just a moment -- is $275.00

What do I do about dogs that bark constantly?

Dogs that bark constantly and disturb neighbors, should be reported to Contra Costa County Animal Control Services at 335-8300. This is the agency responsible for enforcing the County's Barking Dog Ordinance and the Town contracts with the County for this service.

Are door-to-door solicitors allowed in Moraga?

Solicitors must register with the Police Department, and are given a permit which they must carry and exhibit on request. They shall not create any public nuisance or disturb the peace and quiet of the neighborhood by the use of loud noise, brilliant lights or any act offensive to the senses. If you do not want solicitors to come to your door, you must post a sign stating "No Peddlers or Solicitors" to prohibit them from your property.

Can non-members of the Moraga Country Club use the Golf Course?

Members of the public who are not members of the Moraga Country Club are allowed to play the course on the first Tuesday of even months. The cost is $75.00. Carts are $25.00. The Range is open on the first Tuesday of each month to members of the public. Remember proper golf attire, because golfers must adhere to Country Club rules and regulations.

How do I contact the Mayor or a member of the Town Council?

When/where and what time are the Town Council meetings held?

Town Council meetings are held on the 2nd and 4th Wednesdays of each month at 7:00 p.m. at Joaquin Moraga Intermediate School in the Auditorium, 1010 Camino Pablo, Moraga. Upcoming meetings are noted on the Town calendar.

How can I address the Town Council?

Members of the public are invited to address the Town Council at Town Council meetings, held on the 2nd and 4th Wednesday of each month.

  • Please fill out a Speaker Card (available at the Town Council meeting) and submit it to the Town Clerk. Do this before the meeting or before the item is heard. This will ensure that your name is called for the item(s) that you wish to address, and will help ensure the meeting runs smoothly for all participants.
  • When the Council reaches your item on the agenda, the Mayor will open the public comment and call your name. Please address the Council from the podium. Speakers are allowed 3 minutes to address the Town Council, although the amount of time allotted may vary at the Mayor’s discretion, depending on the number of speakers or the length of the agenda. Speakers may not allocate the time to another individual.
  • If you wish to discuss an item that does not appear on the Town Council agenda you may address the Town Council during the “Public Comment” portion of the agenda. Please follow the same procedure for submitting Speaker Cards. Please note the Town Council is unable to discuss or take action on issues presented during Public Comment. According to State Law (The Brown Act-Government Code Section 54954.2), items must first be noticed on the agenda before any discussion or action. The Town Council may refer your issue to staff for attention, or have a matter placed on a future agenda for a more comprehensive action or report.

You may email or call the appropriate Town Department or at the Town Clerk’s Office, Town Hall, 329 Rheem Boulevard, Moraga, Ca 94556. A written request is not required, but may help if your request is complex.

When is the next election?

Elections are held in even years. Elections are held the first Tuesday after the first Monday in November of even-numbered years (coinciding with the State General Election) and serve four-year terms.

Does your office issue marriage licenses?

No, the Town of Moraga does not issue Marriage licenses. You may contact Contra Costa County Clerk’s office.

Does your office issue passports?

No, the Town of Moraga does not issue passports. You may obtain passport information at the Post Office.

Where is my polling place?

How do I get a proclamation on an agenda?

To have a proclamation considered for issuance by the Mayor, please send the desired text of the proclamation to the Town Clerk at 329 Rheem Boulevard, Moraga, CA 94556 or by e-mail to mmcinturf@moraga.ca.us. Proclamations may be presented at the beginning of a Town Council meeting or at a special event. They may also be received by mail.

The Administrative Services Department manages the financial planning and accounting for the Town, including revenue forecasting and expenditure control. The Town Council adopts the Annual Budget for the Town. This year as well as prior year budgets are available on the Administrative Services Department page from Documents and Resources menu on the left.

Does the Town run/operate the schools?

The Town of Moraga and Moraga School District are two different organizations serving residents. They have separate budgets, and sources for funding. The Town has no jurisdiction over the School District.

Questions Regarding Public Works

When is my street going to be repaved?

All streets in Moraga are rated on a Pavement Condition Index (PCI) on a scale from 1 to 100, with 100 being the best. In addition, each street is also rated on usage- how many people use the road. Is it a cul-de-sac or thoroughfare? The usage rating and the PCI are entered into a computerized Pavement Management System (PMS), which calculates the priority of street repairs, given available funding. Bi-yearly the Town performs street improvements based on assessed needs of the Pavement Management System and the availability of funds. Even though a particular street may be rated low on the PCI, if it is not used by a large volume of people, a road that is in better condition that is used by more people may be repaired first. It is less expensive to maintain a good street than to repair a bad street.

Who do I call to report a street light out?

If you see a streetlight that is out or malfunctioning you can report it yourself on the PG&E website or by calling PG&E at 1-800-743-5000.  You can also call the Town Public Works office at 925-888-7026. Be sure to have an exact location and pole number (located approximately 7 feet from the bottom of the pole), for the problem pole.

Who do I call to report a broken sidewalk?

Broken sidewalks are the responsibility of the private property owner. Once a year, the Town inspects all sidewalks for defects that may be hazardous to pedestrians, where the Town could be included in a liability situation. If a sidewalk is determined to be dangerous, the Town notifies the property owner that it must be fixed, or the Town will arrange to have it fixed and bill the property owner.

Who is responsible for repairing the sidewalk in front of my house?

The property owner. Section 12.04.010, A of the Moraga Municipal Code states that, "The owner of a parcel of real property which fronts on any portion of a sidewalk area between the property line and the parcel and the street line, including a parking strip and curb, is responsible for the repair and maintenance of the sidewalk area and shall pay the cost and expense of repair and maintenance."

I'm doing construction. When do I need a permit?

An Encroachment Permit is needed whenever work is to be done that will encroach or impede the public right of way. Fees are as follows:
 
Filing Fee: $125.00
Encroachment Permit: $180.00
Street Cut Permit: $360.00
Work Outside Permit Hours: $500.00 (Before 9:30 a.m. and/or after 3:30 p.m.)
Pavement Restoration Deposit of $1,000.00 plus $5.00/sq. ft. of pavement to be replaced
Street Storage Permit: $30.00/day
Inspection: $90.00/hour

As of February 15, 2005 drainage pipes (roof drains, gutters etc.) installed through curbs are prohibited due to federally mandated storm water pollution prevention. Please call the Public Services office, (925) 888-7026 if you have any questions or for specific information regarding drainage pipes

Who do I call for creek maintenance?

Most creek maintenance is the responsibility of the private property owner. The Town's creek cleaning activities are almost entirely within the street right of way, or in certain stream beds known as M-ditches. Property owners are encouraged to check creek beds and sides for overgrown weeds, trees, or brush which will impede the flow of water. If you have questions regarding responsibility of maintenance please call the Town Public Services office at (925) 888-7026.

Does the Town provide sandbags during winter storms?

No, only during rare extreme circumstances when the Town Council determines that the area is in an immediate state of emergency. Homeowners are advised to contact local suppliers and purchase their own sandbags.

I received a letter from the town telling me that I need to trim my trees, why do I have to do this?

If you were sent a letter notifying you of a safety problem at your property you need to fix the listed problem within the following 14 days. Most of the time these letters are sent to property owner's whose landscaping is encroaching onto the public right of way. For example: bushes at a corner house may be growing too large causing a sight obstruction for traffic at the intersection or blocking pedestrian traffic on the sidewalk. Tree branches may be growing too large and sticking out into the roadway causing an obstruction for large vehicles such as school buses.

I am a realtor and my “Open House” and “For Sale” signs were taken over the weekend, what did I do wrong?

Section 8.88.190 of the Moraga Municipal Code states that, “an open house sign may not be placed on a fence, utility pole or structure, nor a public sidewalk, street, median strip, traffic island or public landscaped area. The Town may remove a sign which encroaches on a public street or right-of-way and collect a fee for the cost of removal as established by council resolution.” The current fee is $40.00. Your sign can be returned to you from the Public Services office at the Hacienda De Las Flores at 2100 Donald Dr. Moraga, CA 94556.
